Paths allocation

General 

 

In accordance with the Act of February 5, 2021 on railway interoperability, railway safety and the certification of train drivers, the ACF is responsible for the following tasks:

a) carrying out its task relating to access to and use of the infrastructure in accordance with the Act of June 6, 2019 on the management, access and use of the railway infrastructure and the regulation of the railway market ;

b) carry out its task relating to pricing in accordance with the law of June 6, 2019 on the management, access and use of railway infrastructure and the regulation of the railway market.

 The Administration is also entrusted with the task of guaranteeing any applicant (any railway undertaking, any international grouping of railway undertakings, etc.) fair and non-discriminatory access to the railway infrastructure and preventing any abuse of a dominant position by one or more applicants to the detriment of others. To this end, it assumes the functions of train path allocation body and rail infrastructure charging body, as provided for respectively in articles 50 and 52 of the law of June 6, 2019 on the management, access and use of rail infrastructure and the regulation of the rail market.

Conditions for obtaining the service

 

Allocation and use of a train path requires a safety certificate issued in accordance with the provisions of the law of February 5, 2021 on railway interoperability, railway safety and the certification of train drivers for any applicant from a beneficiary railway undertaking.

Applicants who are not railway undertakings must designate a railway undertaking holding a safety certificate issued for the Luxembourg rail network.

The following minimum services are included in the provisions of chapter 4 of the DRR:

  • processing of requests for infrastructure capacity ;

  • the right to use the capacity granted;

  • use of network turnouts;

  • regulation of train movements, including signalling, regulation, dispatching and the communication and provision of information concerning train movements;

  • use of the power supply system for traction power

 

Access to the traction power supply system is granted with the allocation of a train path for an electric traction train. Access granted in this way also applies to shunting movements in stations.

 The path request must therefore specify the type of traction. Likewise, the infrastructure manager and the ACF must be informed of any change in traction type prior to the train's running, both for operational reasons (risk of the train running on tracks that cannot be used by it) and for reasons of fees.

The use of the power supply system for traction current is subject to a fee under the conditions and at the price indicated under 6.2.1.5 and 6.3.1.4 in the DRR

  • any other information required for the implementation or operation of the service for which capacity has been granted.
